Who are the controllers for the use of cookies and the data collected?

There are different types of controllers for the use of cookies and other similar technologies in this service (hereinafter, the Controllers):

In the Cookies Configuration section, you are free to decide on each category of cookies and on which of our own cookies or those of the Publisher’s Partners you wish to accept or reject.

Before accepting the use of cookies, you should be aware that some of the Partners are not located in the European Union, nor in other countries with equivalent data protection legislation. How does the use of cookies affect the protection of the user’s personal data?

Most cookies collect information linked to a code that does NOT allow to obtain your name, nor your surname, nor your contact details, nor any other directly identifying data. 

This code acts as a pseudonym to be able to recognise you on each time you visit the service and keep all your information associated with it. For this reason, this code is protected by current data protection regulations (hereinafter, the Pseudonym). 

However, the Pseudonym is only associated with the browser and/or the device that you use, so a switch of browser, device or deletion of cookies will generate a new Pseudonym that is totally different from the previous one. 

The Controllers mentioned in the previous section will process the data associated with the Pseudonym for the purposes you accept from those stated in the Configuration section for the time necessary to fulfil these purposes.

You may withdraw your consent at any time by accessing the Configuration section. 

Although the data protection regulations protect pseudonymised data, the Pseudonym does not allow your identity to be obtained, and therefore it is not possible to apply the rights of access, rectification, erasure, opposition, limitation or portability recognized in these regulations, unless you are able to provide addition that allows your identity to be linked to the pseudonym codes in their cookies. Otherwise, SEUR will not be able to establish which pseudonym corresponds to you. 

If you consider that your right to data protection has been infringed by the Publisher, you can file a complaint at the Spanish Data Protection Agency (www.aepd.es) or at the SEUR’s Data Protection Officer (dpo@seur.net).

What are cookies and how are they used in the Publisher’s services?

This policy applies to any device that stores and recovers data on your device. Cookies, as well as other similar technologies, are files that are files that are installed in the browser of your device during the use of the service, and allow to store information about your visit, your functional preferences and to assign you the Pseudonym.

By their retention period

  • Persistent cookies are those that have a duration determined intime by the person in charge of the service. The retention period can vary from a few minutes to several years. They are used to save and recover certain parameters each time the user visits a service.

  • First-party cookies are those sent to the user’s device or terminal from the computer or domain belonging to the owner of a service, and managed by the latter.

1. Data controller
SEUR, S.A., a Spanish company holding Tax ID Number (N.I.F.) A-28985992 (hereinafter, “SEUR”) is the owner of the trade mark and is the franchisor of the network of franchises that operates in Spain under that name, and it forms a part of the second-largest express transport network in Europe, DPDgroup.
SEUR is the domestic subsidiary of the French company GeoPost S.A., the global parent company of DPDgroup, which provides its subsidiaries with part of the computer infrastructure and which occasionally acts as a service provider or a data processor.
SEUR is therefore responsible for managing the web pages of seur.com; for managing the social network accounts of Facebook, Twitter, YouTube, Instagram, etc.; and for promoting all the products and services of SEUR. Regarding the personal data managed through these channels and services, SEUR is the controller.
On the other hand, unless it is otherwise indicated, the franchisees that are comprised in the SEUR Network are independent companies, albeit operating under the SEUR trade mark pursuant to a franchise agreement.
Franchised companies provide services to their customers, wherefore they are the controllers of the personal data that you, as a customer, have provided in your requests for the rendering of services.
Even though this Privacy Policy describes some of the purposes for which the franchisees may use your data, they may also collect other data about you and may have their own privacy policies that determine how they use that information, which you should consult.

2.- Compilation of personal data
SEUR compiles personal data on various occasions (basically contact data such as name and surnames, address, telephone number, post code, Tax ID number, etc.,):
 - When you contract a service directly with us, whether the transport of merchandise or postal services, such as telegram or certified fax.
 - Whenever you contact us directly, for example through the seur.com website or through the customer service lines, to request information about our products and services.
 - When you participate in our marketing campaigns, for example by filling out a response card or participating in any promotion through our website or social networks that require you to complete an on-line form with your personal data.

SEUR’s products and services, as well as its promotional campaigns, are designed for and targeted at adults in the majority of cases, which is why we will only collect and process your personal data if you are at least 16 years of age. SEUR reserves the right to check the ages of the persons who provide personal data, and it will proceed to eliminate all data corresponding to minors under the age of 16 years.
We would appreciate it if you would help us to keep your personal data updated by informing us of any change to your contact data or your preferences.
 
3.- Purpose
 At SEUR, we process the personal data that you provide to us for various purposes, which are indicated below:
 - User registration and registration for access to the “SEUR PRO” private area: To register as a user or for access to SEUR PRO and for the general administration of your account, it is necessary to provide certain personal data.
 - Contracting of products and/or services: The data provided during the process of contracting transport services for merchandise or for deliveries of certified faxes and/or telegrams are used to manage your contractual relationship with SEUR. During the contracting process, financial data may be collected (bank cards).
 - Customer service: Occasionally, your personal data will be needed to manage incidents related to the contracted services, to process complaints or to respond to requests for information about products, services, rates, etc.
 - Advertising of SEUR's own Products and Services: SEUR may use your data to send general information and commercial communications to you regarding the products and services of its business activity as a postal operator.

 4.- Storage
Your personal data will be stored for the necessary time to comply with the purpose for which they were collected. If your data are used for various purposes, which means that we have to keep them for different periods of time, we will apply the longest period of storage.
 - Purposes related to the performance of a contract: regarding the use of your information for managing any contractual obligation that we may have with you, we will keep those data during the contractual term and for the following ten years so that we can respond to possible consultations or complaints.
 - Marketing purposes: regarding the use of your information for marketing purposes, we will keep that information for said purpose for two years after the date when we last obtained your authorisation to send marketing communications to you, unless you ask us to exclude you from such communications by revoking the consent given.
 - Purposes related to compliance with legal and regulatory obligations: certain information must be kept for the periods required by specific legislation that may be applicable: tax, commercial, money laundering, etc.
 
 5.- Legitimation
The legal basis for processing your data is the performance of the agreement for transport or for certified fax or telegram postal service.
If you have checked the corresponding box, the legal basis for sending advertising about other products and services is your consent, which can be withdrawn at any time.
SEUR will be authorised to process your data whenever it may be necessary to comply with a legal obligation.
Legitimate interest is the legal basis for the processing of your personal data for marketing purposes.
 
6.- Recipients
 SEUR may share your personal data with other entities, including the following:
 - Companies of the Group and third parties such as service suppliers that operate on our behalf and, in a more general sense, any of our commercial partners or suppliers. Social reasons for franchises and subsidiaries
 - External service providers that provide services to us or act on our behalf, specifically to: conduct commercial analyses; process data or payments; provide customer, marketing or public relations services; distribute surveys; or conduct awards drawings.
 - Payment services providers, which are the only ones who process payment information. A payment services provider retains the data pertaining to your bank card only to complete the transaction and only during the period of time that is necessary for managing possible complaints by card holders. This payment information is encrypted and secure.

External service providers will have access to the information, and they may compile it to the extent that they have to do so in order to fulfil their functions. They may not share it or use it for any other purpose.

Rights   

In accordance with applicable laws and regulations, you will have the right of access to, rectification of and erasure of your personal data; the right to restrict access to said data; the right to object to the processing of your personal data; and the right to the portability of your data. Below you will find more information and details about these rights and how you can exercise them.

- The right to access your personal data. In accordance with this right, you may request that we send you a copy of the personal data about you that we store, thereby verifying that we are processing the data legally.
- The right to request that we correct your data if they are inaccurate. You may also complement any incomplete data that we might have, thereby considering the purposes of the processing.
- The right to request the elimination of your personal data, as long as it complies with the requisites set forth in applicable laws.
- The right to object to the processing of your personal data, unless SEUR has an overriding legitimate interest or has to continue processing your personal data in order to establish, exercise or defend itself against a judicial claim.
- The right to restrict the processing of your personal data in the events provided for in applicable regulations.
- The right to the portability of your data. You may request that we send you the personal data that affect you, in a commonly used, structured and computerised format. You may also request that we send said personal data to a third party, in the cases in which this is feasible. You will only hold this right if it concerns personal data that you have provided to us, if the processing of said data is based on consent or is necessary for the operability of a contract between you and us and if the processing is done through automated means.

The exercise of these rights by you is subject to certain exceptions for reasons of general interest (for example, the prevention or detection of crimes) and for our own interests (for example, maintaining the confidentiality of legal advising). If you exercise any of these rights, we will verify that you are actually authorised to do so, and we will respond within the period provided for in applicable regulations.

If you are not satisfied with the way in which we use your information or with our response to the exercise of any of these rights, you may lodge a complaint before the Spanish Data Protection Agency at the postal address, C/ Jorge Juan 6, C.P. 28001 – Madrid, or at the website, www.agpd.es.

SEUR reserves the right to amend this policy to adapt to new legislation or jurisprudence, as well as to the services offered.

Protection of Information   

At Seur we are aware of how important the protection of information it is to our customers. To this end we have adopted, and are committed to the ongoing adoption of, a series of measures to protect the privacy and confidentiality of the customer information that we receive, store and/or process.

It is our aim to guarantee total respect for the confidentiality and privacy of all the customer information that we collect and process, in accordance with legal requirements.

For this reason Seur does not sell nor in any way commercially exploit customer information. It does not pass on customer information to third parties not involved in the relevant transaction, except where consent has been obtained in accordance with the provisions of this policy, where the applicable law requires it or when necessary for provision of a service.

The most important purpose for collecting and storing information about our customers is to ensure the efficiency, safety and speed of the shipments we transport.

Seur uses the information gathered to fulfil transport contracts and service agreements and may use some of this information to communicate with our customers in order to improve our services and better provide information about our current and future services. 

Information of a personal nature is obtained directly from the forms you use to provide us with your details, giving consent to their use. The purposes of the automated collection and handling of data are:
  • The execution and maintenance of any contractual relationships that may exist between Seur and its users and customers.
  • The execution, management, administration, expansion and improvement of the any such Services as are sought and/or accessed by users and customers.
  • The dissemination of general, technical, operational and promotional information about our products and shipping, transport and logistic services via various media, such as email, mobile telephone and standard mail. Authorisation is always sought before sending this material.
  • Internal marketing research conducted with the aim of improving our products and shipping, transport and logistic services.
Automated data collection and processing is also used to send forms seeking feedback about the web page, to which users are not obliged to respond. 

Links with other web sites   

Seur provides links to other web sites which we believe users may find of use.

The terms and conditions of the privacy and confidentiality policy are not applicable to these links and their inclusion does not imply an obligation on the part of Seur when accessing the products or services promoted or sold on them.

Security measures   

All customer information is considered as a company asset and as such we employ information security and computer protection measures to protect our systems against unauthorised access, both by external users and employees who are not legally authorised to access such information. 

With the aim of ensuring security and confidentiality of transactions, the system requires that users and/or customers are first identified and authorised by passwords when accessing services that require the entering of personal data.

In those cases where the user requests information about services or shipments or wishes to make a claim or report an incident via the appropriate forms on the Seur web site, it shall in all cases be necessary to collect that data necessary to keep the user informed about the request.

We are aware of the need to safeguard the transmission of data between Seur and its customers. For this reason all transactions are conducted over a secure server using the SSL (Secure Socket Layer) protocol, which is immediately activated upon electronic access to the service.

The secure server uses a connection which transmits information encrypted by 128-bit algorithms. This ensures that the information can only be read by the customer's computer and our server. 

IP Addresses   

An IP address is the identifier given by an internet service provider (ISP) to a device that connects to the internet. Seur receives information about the IP addresses of visitors to its web page as browsers pass it on automatically each time they open a web page. This information about IP addresses helps Seur administer its systems, control and improve security, resolve problems, optimise service and analyse traffic statistics.

Privacy Policy for Contacts (NEW)   

The personal data provided by you or by third parties are part of a file under the responsibility of SEUR S.A (hereinafter SEUR) with address at C/Gamonal 6, C.P. 28031 – Madrid, in order to manage and maintain the contacts and relationships that arise as a result of the relationship that it maintains with SEUR or with any of its employees. The legal basis that legitimises this treatment is your consent, the need to manage a contractual or similar relationship, or SEUR's legitimate interest in channelling the appropriate communications with you. The period of conservation of your data will be determined by the relationship that you maintain with SEUR. Personal data will not be transferred to third parties except legal obligation. At any time you can exercise your rights of access, rectification, deletion, opposition, limitation, portability or revoke your consent, by sending a written communication to the indicated address, proving your identity and specifying your request. Likewise, if you consider your right to the protection of personal data violated, you may file a claim with the Spanish Agency for Data Protection (www.aepd.es) or with the Data Protection Delegate dpo@seur.net
